These terms govern access to and use of the VMLearn platform (https://www.vmlearn.com). They constitute an agreement between the user and Technologies VMLearn inc.. The Acceptable Use Policy and the Privacy Policy form an integral part of them. Use of the platform constitutes acceptance of these terms.
Access is reserved for students and staff of educational institutions that have entered into an agreement with Technologies VMLearn inc.. Accounts are created by the institution. The user is responsible for the confidentiality of their credentials and for all activity carried out through their account. Accounts are personal and may not be shared. Any suspected compromise must be reported without delay to the institution or to info@vmlearn.com.
The content of the platform — courses, lessons, labs, simulations, questions, solutions, text, images and software — is the property of Technologies VMLearn inc. or its licensors and is protected by the Copyright Act (R.S.C. 1985, c. C-42). Technologies VMLearn inc. grants the user a personal, non-exclusive, non-transferable and revocable licence to access and use it for training purposes for the duration of their enrolment. Any reproduction, bulk download, recording, automated extraction, distribution, sale or use for competing purposes is prohibited.
The user retains their rights in the content they produce in the labs and grants Technologies VMLearn inc. a licence to retain it and communicate it to the educational institution for assessment purposes.
Use of the platform is subject to the Acceptable Use Policy. Activity on the platform is logged and monitored under the conditions set out in the Privacy Policy.
The platform is provided without guarantee of continuous availability. Interruptions for maintenance may occur. Lab sessions have a limited duration and may be closed automatically in case of inactivity. Technologies VMLearn inc. may modify, add or withdraw any content or feature.
Technologies VMLearn inc. may suspend or terminate access, without notice, for a breach of these terms or of the Acceptable Use Policy, or at the request of the educational institution. Access ends with enrolment. Personal information is then handled in accordance with the Privacy Policy.
The platform and its content are provided "as is", for training purposes. Lab environments deliberately reproduce vulnerable systems; the techniques taught may only be applied within those environments or on systems for which the user holds written authorisation. To the extent permitted by law, Technologies VMLearn inc. is not liable for indirect, incidental or consequential damages arising from the use or unavailability of the platform. These terms do not limit rights that the law does not permit to be waived.
The user shall indemnify Technologies VMLearn inc. against any claim, loss or damage resulting from a use of the platform contrary to these terms or to the law.
These terms are governed by the laws of Quebec and the federal laws of Canada applicable therein. Any dispute falls under the exclusive jurisdiction of the courts of the judicial district of Montreal, subject to mandatory remedies provided by law.
Technologies VMLearn inc. may amend these terms. The version in force and its update date are published at this address. Use of the platform after publication constitutes acceptance of the amended terms.
